The Varsity Network Terms & Conditions

The goal of The Varsity Network is to grow the academic athletic support profession in secondary education with the aim of providing schools and talented educators with winning strategies and resources for the development of high impact student athlete development programming. Positive youth development through sport matters, and active and involved adult educators/athletic coaches/staff members can inspire students, by capitalizing on their passion for sports, to be engaged in their classroom assignments, excited about school activities, and build pride of their school’s success. Every educator/athletic coach/staff member has something valuable to offer in supporting student athlete development, and this network provides opportunities and resources for educators to empower their student athletes.

INTRODUCTION

  1. These terms and conditions apply to all Schools approved by AthLife to deliver and/or participate in the Network and any activities under the Network.
  2. The School’s eligibility to participate in the Network is subject to its satisfaction of and compliance with these terms and conditions.
  3. AthLife may at any time by notice to the School vary these terms and conditions.
  4. These terms and conditions apply without limitation to or from the User Terms and Conditions applicable to users of the Site.

DEFINITIONS

In these terms and conditions:

  1. “AthLife” means the AthLife Foundation;
  2. “Educator” means an individual (being an employee, contractor, or volunteer of a School) nominated by a School or other community partner to deliver or participate in activities under the Network;
  3. “Network” means The Varsity Network network;
  4. “School” means an educational establishment whose major activity is the provision of full-time primary or secondary education accepted by AthLife to conduct, deliver, or participate in activities under the Network;
  5. “Site” means AthLife’s and the Network’s website;

DECLARATION

By completing and submitting this form to AthLife for the Network, the School declares that it:

  1. Will conduct all activities related to the Network with the highest standards, professionalism, and good taste, and will do nothing to cause detriment to the reputation or goodwill of AthLife and/or the Network;
  2. Will comply with all AthLife’s applicable policies, procedures, guidelines, or other lawful directions notified to it by AthLife during its participation in the Network and to abide by all the rules and requirements of each activity within the Network;
  3. Will deliver activities under the Network entirely at its own risk.
  4. To its knowledge it has no matter that AthLife may consider to constitute a risk to the Network’s reputation or the Network’s members, employees, volunteers, Schools, participating student athletes by the School participating in the Network;
  5. All the information provided by the School in seeking to participate in the Network is true and correct;
  6. The School will notify AthLife immediately upon becoming aware that any of the matters set forth herein has changed for whatever reason; and
  7. It has read, understood, and accepted all of these terms and conditions.

ACKNOWLEDGEMENTS

By completing and submitting this form to AthLife for the Network, the School hereby acknowledges and agrees that:

  1. Its application to participate in the Network is completely voluntary and if selected, the School agrees to offer its services on free and voluntary basis without any entitlement to payment or other compensation from AthLife;
  2. Its participation in the Network imposes no obligations on AthLife;
  3. The right to select applicants to participate in the Network rests solely and exclusively with AthLife and that AthLife reserves the right not to offer you a volunteer role, nor is AthLife under any obligation to justify any reason for rejecting your application;
  4. Its participation in the Network is subject to the School’s ongoing desire to establish an Academic Athletic support position and student athlete development programming;
  5. It only remains eligible to participate in the Network if it: (i) completes the End of Year Data Collection Protocol and (ii) sends one (1) or more staff members to the annual AthLife Foundation National Conference (July 2018);
  6. AthLife is under no obligation to provide direct support services or consultation to the schools, but will maintain reasonable responsiveness to requests for support within it’s operational standards and protocols;
  7. At no time will the School be considered an employee, contractor, partner, or agent of AthLife in relation to the Network; and
  8. Coaches, Schools, and/or Teachers are not employees, contractors, partners, or agents of AthLife.

TERMINATION

By completing and submitting this form to AthLife for the Network, the School understands and agrees to the following:

  1. AthLife may at any time by notice, in its absolute discretion, suspend or terminate participation of the School and/or the Coach in the Network.
  2. Without limitation to paragraph 8(a) directly above, where the School and/or the Coach breaches any of these terms and conditions, AthLife may, in its absolute discretion, suspend or terminate participation of the School and/or the Coach in the Network.

MISCELLANEOUS

By completing and submitting this form to AthLife for the Network, the School understands and agrees to the following:

  1. The School must not, without the prior written consent of AthLife, publish, distribute, or communicate any material relating to the Network, whether developed by the Coach or otherwise, including any publicity materials, sponsorship messages, or participant handouts intended for distribution to students, parents, or schools.
  2. The School must not, without the prior written approval of AthLife, use the name or logo of AthLife for any purpose.
  3. To the extent permitted by law, the School agrees to indemnify AthLife and its officers, directors, members, and employees against any losses, damages, claims, and expenses incurred or suffered by AthLife which arise out of, are caused by, are attributable to, or result from anybreach of these terms and conditions or any wrong or negligent act or omission of the School and/or its coaches, staff, employees, or agents in connection with the Network.
  4. If any provision of these terms and conditions is held to be invalid, unenforceable, or illegal for any reason, such provisions will be deemed severed from these terms and conditions without affecting the enforceability or validity of the remaining provisions which shall continue in full force and effect.
  5. These terms and conditions are governed by the laws of the State of New York.
